Introduction

This service is operated by Whisky Asset (UK) Limited (we, us or our). We are registered in Scotland under company number SC700640 and have our registered office at 1 West Regent Street, Glasgow, G2 1RW.

Please read these Terms carefully. By accessing and using our website and any content and features therein (including without limitation any games, widgets, embeddable media players and RSS feeds) (together, our Services), you accept these Terms, the Privacy Policy and any notices, guidelines and rules published by us from time to time. If you do not accept these Terms, please do not use our Services.

We may update these Terms at any time. Continued use of our Services after updates means you agree to be legally bound by the updated Terms.

Use of our Services

You agree to use our Services only for lawful purposes and in a way that does not infringe the rights of, or restrict the use and enjoyment of, any other person.

User Contributions to our Services

  • you will not forge packet headers or transmit spam/phishing content; and
  • our use of your contribution will not require us to pay fees to third parties.

You waive moral rights to the extent permitted by law and agree to execute any further documents reasonably required to confirm rights granted under these Terms. User Contributions are treated as non-confidential.

Removal of Materials

We may, but are not obliged to, review User Contributions. We may remove or disable content, revoke registration, block IP addresses, or otherwise enforce these Terms at our discretion, with or without notice.

If you are a rights-owner (or agent) and believe content on our Services infringes your rights, send an email titled "Removal request" to the general email address listed on the Contact Us page of the relevant website.

Your notice should include:

  • details and location of the allegedly infringing content (URL and/or screenshot);
  • your contact details; and
  • a statement that you are authorized, act in good faith, and that your notice is true and accurate.

Reliance on Information

Information on our Services is for general information only and is not advice. We do not warrant that Materials are accurate or error-free and disclaim liability for reliance placed on content by you or others.

We do not endorse User Contributions, opinions, recommendations, or advice posted by users, and we disclaim liability in connection with such content.

We may update, suspend, or close our Services at any time. Materials may be out of date and we are under no obligation to update them.

Warranties and Disclaimer

Our Services are provided "AS IS" and "AS AVAILABLE" without representation or endorsement. To the fullest extent permitted by law, we disclaim all warranties, conditions and other terms, including as to quality, fitness for purpose, non-infringement, compatibility, security and accuracy.

We do not warrant uninterrupted or error-free operation, that defects will be corrected, or that Services and servers are free of viruses or bugs.

Limitation of Liability

We accept no liability in respect of User Contributions. Your use of our Services, Materials and User Contributions is entirely at your own risk.

To the fullest extent permitted by law, we and connected third parties exclude liability for direct, indirect, consequential, special or exemplary loss or damage, including injury to persons/property, third-party losses, data loss, lost revenue, lost profits, lost business, lost opportunity, lost savings, wasted management time, and loss of goodwill or reputation.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter, or any other liability that cannot be excluded by law.

We are not responsible for breaches caused by circumstances beyond our control.

Reimbursement by You

You agree to reimburse us, and any of our officers, directors, employees, agents, licensors, suppliers and service providers, on demand for claims, actions, proceedings, damages, losses, liabilities, costs and expenses arising from your use of our Services other than in accordance with these Terms or applicable law.

Viruses, Hacking and Other Offences

You must not misuse our Services by introducing malware or harmful code, attempting unauthorized access, or attacking our Services via denial-of-service or similar methods.

Breach of this provision may constitute an offence under the Computer Misuse Act 1990. We may report breaches to law enforcement and cooperate by disclosing your identity. Your right to use our Services will cease immediately in such cases.

Subject to these Terms, we grant you a non-transferable, non-sub-licensable, royalty-free, non-exclusive license to display selected content from our Services.

YOU MAY NOT DIRECTLY OR INDIRECTLY CHARGE USERS FOR ACCESSING OUR CONTENT, COMMERCIALIZE IT, OR RE-SELL IT. RSS FEEDS, WIDGETS AND EMBEDDABLE MEDIA PLAYERS MAY NOT BE USED IN CONNECTION WITH COMMERCIAL ACTIVITIES.

We may restrict, suspend or terminate feeds, widgets, players, licenses, or access at any time without liability.

Order of Precedence

If there is a conflict between these Terms and specific terms appearing elsewhere on our Services for specific material (including any Code of Conduct), those specific terms prevail.

Severability

If any provision of these Terms is held illegal, invalid or unenforceable, that provision will be severed in that jurisdiction and the remaining provisions will continue in full force and effect.

These Terms are governed by and construed in accordance with the laws of Scotland and the United Kingdom.

Disputes

Any disputes arising from or related to our Services are subject to the jurisdiction of the courts of Scotland and the United Kingdom.
